Understanding the Code of Conduct for Migration Agents
The Code of Conduct for registered migration agents is a legal framework established to govern the behavior of registered migration agents, outlining their obligations towards clients. This code is enshrined in legislation, specifically in Section 314 of the Migration Act 1958, and detailed in Schedule 2, Regulation 8 of the Migration Agents Regulations 1998.
Key Elements of the Code of Conduct:
1. General Duties: The Code outlines general duties that registered migration agents must adhere to in their professional practice.
2. Duties related to Australia’s Immigration System: Specific obligations regarding the conduct of migration agents within the context of Australia’s immigration system.
3. Duty to Maintain Skills and Knowledge: Migration agents are obligated to continuously update and enhance their skills and knowledge to provide effective services.
4. Duties Related to Practice Management: Guidelines on how agents should manage their practice to ensure professionalism and efficiency.
5. Duties Relating to Keeping Authorities Informed: Agents are required to inform relevant authorities, clients, the Department, and Review Authority about matters related to migration.
6. Duty to Respond to Requests for Information: Agents must promptly respond to requests from authorities for information or documents.
Display and Distribution Obligations:
Registered migration agents are also obligated to prominently display the Code of Conduct in their office and client waiting area. Additionally, they must provide clients with a copy of the Code if requested.
Practice Guides:
To assist registered migration agents in fulfilling their obligations under the Code of Conduct, the Office of the Migration Agents Registration Authority (OMARA) provides practice guides. These guides serve as valuable resources to support agents in navigating and meeting their professional responsibilities.
